Jobsgenie.co Limited is a company registered in England and Wales under company number 10485065 and having its registered office address at 359 Goswell Road, London, England, EC1V 7JL.
If you have opened or are applying to open an employer account through our Website or if such an account has been or is being opened on your behalf you are an Employer Account Holder and these Terms shall apply to you in addition to our Terms of Website Use and Privacy Policy. Our Agreement is with the Employer Account Holder and the Employer on whose behalf the Employer Account Holder is acting and a reference to an Employer Account Holder or to ‘you’ shall, unless the context requires otherwise, include a reference to the Employer.
Using the features described in these Terms will require you to have an active account. Membership of our Website is only available to work-seekers and Employer representatives. Membership is not available to external recruiters. The opening and continuation of any account on our Website is at our discretion. We will not unlawfully discriminate against you but we may otherwise refuse to open or terminate an account without any liability to the account holder at any time without being required to give a reason.
Definitions & Interpretation
In this document, the following definitions apply (in addition to the other definitions set out in this document):
Agreement: the agreement between jobsgenie.co, the Employer Account Holder and the Employer formed upon acceptance of these Terms.
Candidate: a work-seeker using our Website.
Employer: the organisation on whose behalf the Employer Account Holder represents to be acting.
Employer Account Holder: is defined in the Introduction.
Group Company/Group Companies: a company’s group companies are companies which are ultimately controlled by the same person or persons as the company and Group Company shall mean any such company. A company is controlled by a person or persons if they hold more than 50% of the voting rights in the company and/or 50% of its ordinary shares.
Known: a Candidate becomes Known to an Employer when the Candidate’s identity is revealed to a representative of the Employer in connection with use of our Website by that representative provided that the Candidate was not previously known to the Employer.
Placed: a Candidate is considered to have been Placed when they accept an offer to work for the Employer (or a Group Company of the Employer), whether as an employee or on a self-employed basis, within six months of having become Known to the Employer in connection with our Website and Placing, Places and Placement shall be interpreted accordingly.

Acceptance of Terms
The acceptance of these Terms may occur in any of the following ways:
• you register as an Employer Account Holder on our Website;
• these Terms are brought to your attention and at your request we open an account on your behalf; or
• you otherwise accept these Terms.
Our Services
Jobsgenie.co provides a platform for Employers to find candidates for their vacancies directly using a structured database of work-seekers. Work-seekers provide key information about their experience and the role they are seeking enabling Employers to filter the available talent and shortlist for interview those Candidates who are the best match for them. During the search stage, Candidates’ identities are hidden from Employers.
Employer Account Holders can send Candidates an interview or contact request. If this is accepted, the Candidate’s identity will be revealed and the recruitment process can proceed in the usual way.
Our services are directed at commercial and technical recruitment in a wide variety of organisations. Our Website is not intended to be used for the recruitment of health or social care professionals or any other persons working with vulnerable people and you agree not to use our Website for this purpose.
All of our services are web based. We reserve the right to withdraw and modify our services and to make free services chargeable at any time.
Employer’s Responsibilities
Employer Account Holders must supply sufficient information to enable us to select a suitable Candidate for each position, including the following:
• the identity of the Employer and, if applicable, the nature of the Employer’s business;
• the date on which the Employer requires a Candidate to commence work and the duration, or likely duration, of the work;
• the position which the Employer seeks to fill, including the type of work a work-seeker in that position would be required to do, the location at which and the hours during which he would be required to work and any risks to health or safety known to the Employer and what steps the Employer has taken to prevent or control such risks;
• the experience, training, qualifications and any authorisation which the Employer considers are necessary, or which are required by law, or by any professional body, for a Candidate to possess in order to work in the position;
• any expenses payable by or to the Candidate;
• the minimum rate of remuneration and any other benefits which the Employer would offer to a person in the position which it seeks to fill, and the intervals at which the person would be paid; and
• where applicable, the length of notice which a Candidate in such a position would be required to give, and entitled to receive, to terminate the employment with the Employer;
and update this information as necessary during the recruitment process.
Employer Account Holders agree to keep CVs and other information relating to Candidates disclosed to them confidential and not to use that information for any purpose other than considering a Candidate for a role within the Employer’s business.
Employer Account Holders agree to notify jobsgenie.co immediately when a Candidate is Placed, to provide us with the Candidate’s start date, salary and benefits and any revised start dates and to confirm whether the Candidate is still in post (or otherwise engaged by the Employer) on the expiration of the Rebate Period.
All communication between Employers and Candidates prior to Placement should so far as is practicable be through our Website.
Recruitment Fees
The fee for use of our service is 5% (plus VAT) of each Placed Candidate’s gross salary with the Employer or, in the case of self-employed Candidates, gross fees for the first year of service which would be received by the Candidate or the Candidate’s service company in the ordinary course of events or such other fee as may separately be agreed between jobsgenie.co and the Employer in writing (the Recruitment Fee). The Recruitment Fee will be the total fee which will be payable to jobsgenie.co by the Employer if a Candidate is Placed. The Recruitment Fee is a service fee payable by the Employer to us.
We may invoice the Employer for the full Recruitment Fee at any time after a Candidate has been Placed for payment on the Candidate’s employment start date. Following receipt by us, the Recruitment Fee (or part of it) will be subject to rebate until the Rebate Period (if any) has elapsed. The Rebate Period is the period during which some or all of the Recruitment Fee will be refundable if the Candidate leaves the Employer’s employment. The Rebate Period and the commercial terms applying during the Rebate Period will be as follows unless otherwise agreed in writing:
Rebate period: 60 days from the Candidate’s start date
Rebate amount:If the Placement of any Candidate is terminated for any reason within 60 days of their start date, the following rebate structure will be followed:0 to 30 days from start date = 100% rebate of the Recruitment Fee31 to 60 days from start date = 75% rebate of the Recruitment Fee
Notwithstanding the foregoing, if the Employer has failed to pay the Recruitment Fee to us within 30 days of the due date of our invoice, any rebate will be forfeited and the Recruitment Fee may be recovered by us in full even if the Candidate has left the Employer’s service before the end of the Rebate Period.
Employer Account Holders agree not to engage in any arrangement or practice which is designed to circumvent the payment of fees to jobsgenie.co.
LIMITATION OF LIABILITY
OUR SERVICE IS PROVIDED “AS IS” FROM TIME TO TIME. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL CONDITIONS, WARRANTIES, REPRESENTATIONS OR OTHER TERMS WHICH MAY APPLY TO OUR SERVICE INCLUDING OUR WEBSITE OR ANY CONTENT ON IT, WHETHER EXPRESS OR IMPLIED.
WE WILL NOT BE LIABLE TO YOU FOR ANY LOSS OR DAMAGE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY, OR OTHERWISE, EVEN IF FORESEEABLE, ARISING UNDER OR IN CONNECTION WITH:• USE OF, OR INABILITY TO USE, OUR WEBSITE; OR• USE OF OR RELIANCE ON ANY CONTENT DISPLAYED ON OUR WEBSITE.• LOSS OF PROFITS, SALES, BUSINESS, OR REVENUE;• BUSINESS INTERRUPTION;• LOSS OF ANTICIPATED SAVINGS;• LOSS OF BUSINESS OPPORTUNITY, GOODWILL OR REPUTATION; OR• ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE.
WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A VIRUS, DISTRIBUTED DENIAL-OF-SERVICE ATTACK, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF OUR WEBSITE OR TO YOUR DOWNLOADING OF ANY CONTENT ON IT, OR ON ANY WEBSITE LINKED TO IT.

• THE CANDIDATE’S IMMIGRATION STATUS AND RIGHT TO WORK
• THE CANDIDATE’S QUALIFICATIONS
• ANY OTHER RELEVANT INFORMATION PROVIDED BY THE CANDIDATE
AND TAKING UP ANY NECESSARY REFERENCES.
SAVE IN RELATION TO OUR OBLIGATIONS TO REBATE RECRUITMENT FEES RECEIVED BY US (WHERE APPLICABLE) OUR MAXIMUM AGGREGATE FINANCIAL LIABILITY TO YOU IS LIMITED TO THE SUM OF £100 IN CONNECTION WITH ANY AND ALL CLAIMS.
YOU AGREE NOT TO BRING LEGAL PROCEEDINGS OF ANY KIND AGAINST ANY COMPANY WHICH OR PERSON WHO MAY FROM TIME TO TIME OWN SHARES IN JOBSGENIE.CO LTD OR ANY OF OUR OFFICERS OR EMPLOYEES IN EACH CASE IN CONNECTION WITH OUR WEBSITE OR SERVICE.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM OUR NEGLIGENCE, OR OUR FRAUD OR FRAUDULENT MISREPRESENTATION, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY ENGLISH LAW.
Privacy
‘Personal data’ within the meaning of the Data Protection Act 1998 which you submit to us will be processed by jobsgenie.co in accordance with our privacy policy as ‘data controller’.
Employers will become data controllers in common with jobsgenie.co in relation to the personal data of Candidates which is made available in an Employer Account Holder’s account. Each Employer Account Holder accepts that the personal data of Candidates available in their account is to be processed by them strictly in accordance with the instructions of the Employer on whose behalf they are acting, both during and after they have ceased to be a representative of the Employer concerned. Candidate data is provided solely for the purpose of the Employer considering the Candidate for a role within the Employer’s organisation and should not be processed for any other purposes save where this is compatible with the law.
The Employer agrees to comply with UK data protection laws in relation to all data which is exported by the Employer from our Website.
Confidentiality
By using our Service, you will be given access to features of our Website which we consider to be confidential. You agree not to use your access to the Website for the purpose of creating a duplicate or similar service in any jurisdiction.
All information about Candidates which is not in the public domain shall be considered confidential and treated as confidential information by Employer Account Holders. Such information should not be used or disclosed except where this is required for the purpose of considering a Candidate for an engagement or is required by law.
Publication of Membership Status
To encourage more users to visit our Website, we would like your permission to publish the fact that we are a supplier to the Employer. By using our service, you grant us permission to publish this information and to copy and make use of the Employer’s logo on page(s) in our Website. You may withdraw your permission at any time by emailing us at admin@jobsgenie.co.
Indemnity
The Employer Account Holder and Employer agree to indemnify jobsgenie.co, its Group Companies and its directors, officers and employees in relation to all losses, costs and expenses caused by breaches of our Terms and Conditions by the Employer Account Holder or the Employer.
Changes
We reserve the right to make changes to these Terms. Changes will have a prospective effect only and will not affect our respective obligations in relation to Placements which occurred prior to the date of change (whether the Candidate’s start date is before or after the date of change). If we consider a change to be material, we may (in our absolute discretion) alert you to the fact that the change has been made. However, it is your responsibility to check this page before engaging in any activity on our Website, as continued use of our Website will constitute acceptance of the revised terms.
Miscellaneous
These Terms and the other documents comprising our Terms and Conditions set out the entire agreement between us in relation to the provisions of our services to Employer Account Holders.
In entering into the Agreement, you have not relied upon any representation which is not set out in our Terms and Conditions.
No addition to, or modification of, any of our Terms and Conditions shall be valid unless it is made or approved by a director of jobsgenie.co in writing.
If any provision of our Terms and Conditions is found by a court of competent jurisdiction to be unenforceable, it shall be severed from the remaining provisions of the Agreement which shall continue in full force and effect.
The benefit of your Agreement with us is assignable by us to any person or corporation, including without limit any Group Company and any successor to us as provider of the service.
The Agreement and any non-contractual claims arising from your membership or use of the Website will be governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in relation to any disputes arising under or in connection therewith, SAVE THAT we shall be entitled to commence and prosecute legal proceedings against you in the courts of any jurisdiction.

Candidate’s Responsibilities
Upon completing your profile, you represent to us and agree that:
• you are eligible to work in the UK and have all necessary visas or permits (if required) and undertake to produce evidence of identity and work permit status upon request;
• all information supplied by you to jobsgenie.co is true, accurate and complete; and
• you are willing to work in vacancies of the type which you tell us you are seeking.
You agree to notify jobsgenie.co immediately when you are Placed, to provide us with your start date, salary and benefits and any revised start dates and to confirm whether you are still in the post (or otherwise engaged by the Employer) when asked.
We will assume that your work search is continuing and that your profile is up-to-date whilst your profile remains active. You agree to change the status of your profile when you stop searching for a new job and to keep it updated whilst your work search is continuing.
Our Services
Jobsgenie.co provides a platform for Candidates to record key information about their experience and the job they are seeking in a structured format which enables Employers to search for Candidates based on their responses and invite suitable Candidates for interview.
During the search stage, Candidates’ identities will be hidden from Employers. If an Employer would like to take the process further, they will send you an interview or contact request. If you choose to accept, your identity will be revealed to the Employer at this stage
Your anonymous profile will be available either to all Employers or to all Employers other than those from which you have asked for it to be hidden. We will use our best endeavours to implement your wishes in relation to the privacy of your anonymous profile. To help us to do this effectively you should ensure that company names are given as fully as possible, that associated companies are listed individually and that you update your preferences when name changes occur.
Jobsgenie is part of the Post & Place group (www.postandplace.com). In addition to providing you with membership of our Website, our Group Companies may also be able to assist you with your work search. You may therefore be contacted by representatives of our Group Companies.
Our services, and the services of our Group Companies, are free of charge for Candidates.
Our services are currently directed at commercial and technical recruitment in a wide variety of organisations. Our Website is not intended to be used for the recruitment of health or social care professionals or any other persons working with vulnerable people. If you are searching for a job which involves working with vulnerable people, you should not register with our Website.
Referral Fees
If you refer another candidate to jobsgenie.co and they go on to be Placed, subject to the following terms and conditions, we will pay you a £1,000 referral fee (Referral Fee).
The Referral Fee:
• is only payable in relation to the candidate’s first Placement; and
• is not payable until after we have received the full recruitment fee plus any applicable VAT from the Employer in relation to the Placement and any right of the Employer to receive a rebate of all or any part of the recruitment fee has expired.
We will email you to notify you when a Referral Fee is payable. If you do not provide us with bank account details within 3 months of our email, any right to receive the Referral Fee will lapse. Referral Fees are only payable by bank transfer.
LIMITATION OF LIABILITY

The Employer will be the sole data controller in relation to Candidate data which is removed from our Website and placed on systems under the control of the Employer. Our terms and conditions restrict the purposes for which the Personal Data of a Candidate can be used by an Employer but jobsgenie.co is not responsible for the activities of Employers or their representatives to who Personal Data is made available in accordance with this Privacy Policy.
